1. Agreement to Terms
By downloading, installing, or using Scream4U.icu ("App"), you agree to these Terms & Conditions ("Terms"). If you disagree with any part of these Terms, do not use the App.
These Terms constitute a legally binding agreement between you ("User," "you") and Scream4U.icu ("we," "us," "our").
2. How the App Works
2.1 Service Description
Scream4U.icu is an offline-first emergency alert application that:
Stores your personal information locally on your device
Generates pre-filled emergency SMS messages
Opens your device's native SMS app for sending alerts
Allows you to manage emergency contacts and address information
Provides test functionality to verify the system works
2.2 Emergency Alert Process
Two-Tap Emergency Process:
First Tap: Press an emergency button (Medical, Fire, Intruder, or Personal Safety)
The app generates an SMS containing: emergency type, your name, your address, GPS coordinates (if enabled), and timestamp
Your device's SMS app opens with pre-filled messages for your contacts
Second Tap: You manually tap "Send" in your SMS app
SMS is sent via your cellular carrier (not through our servers)
Accidental Activation: If you press an emergency button by mistake, simply close the SMS app or don't tap "Send" in your SMS app - no messages will be sent. The app does NOT send messages automatically.
📍 Address and Location Information - Critical Points
Manual Address Entry: You manually enter your home address and must update it when your location changes (traveling, moving, etc.).
Optional GPS Location (v1.0.2+):
The app offers optional GPS location access for more accurate emergency alerts
GPS coordinates are NOT guaranteed - many devices require internet for GPS to work
GPS is ONLY accessed when you send an emergency alert (not tracked in background)
GPS coordinates are included in SMS as a Google Maps link if permission granted and GPS is available
You can enable or disable location permission anytime in Settings
If GPS fails or is disabled, SMS still sends with your home address
Critical: GPS Limitations: GPS coordinates depend on your device hardware and internet connection. Many devices cannot obtain GPS coordinates without WiFi/data. Your home address is the ONLY guaranteed location information - keep it current.
Privacy Note: GPS location is obtained directly on your phone at the moment you press an emergency button. The app retrieves your coordinates once, includes them in the SMS message, and then discards them immediately. Scream4U.icu never sees, tracks, or stores your GPS coordinates because we cannot access your phone's native SMS app. Everything happens locally on your device.
Your Responsibility: You are solely responsible for keeping your address accurate and current. Emergency contacts receive the address you provide - if it's wrong or outdated, they cannot find you.

3.3 Payment Flow and Activation

Our automated system (Google Apps Script) processes payment every 5 minutes
System generates unique 16-character activation code (SUBS-XXXX-XXXX-XXXX-XXXX)
Code is emailed to your PayPal email address within 2-5 minutes
You enter code in app to activate 365-day subscription
Code does not expire and can be activated anytime after purchase
Once activated, subscription is valid for 365 days from activation date (not purchase date)
Code is stored hashed (SHA-256) on device for security
Device ID recorded when code is activated
3.4 Billing and Renewal
Billed annually in advance ($19.99/year or $9.99/year for Founders)
No automatic renewal - you must manually purchase new subscription
Renewal reminder sent 30 days before expiration (daily check at 9 AM)
Renewal email contains personalized PayPal.me link with correct pricing for your tier
You receive a NEW activation code when you renew
New code starts a NEW 365-day period (doesn't extend old period)
Founders pricing maintained on renewal if subscription remains active
3.5 Device Limitations
One Device Per Subscription: Each subscription is linked to one active device via device identifier
Transfer Anytime: Enter same activation code on new device to transfer
Transfer Process: On new device, enter activation code → old device auto-deactivated
Transfer Limit: Maximum 3 device transfers per subscription period. Additional transfers require contacting support@scream4u.icu
Note: Address information does NOT transfer - you must re-enter it on the new device
Sharing Prohibited: Using one subscription on multiple devices simultaneously is prohibited and may result in termination
3.6 Email Requirements
Critical for Service: Your email address is the ONLY method we use to communicate:
Activation code delivery after payment
Renewal reminders 30 days before expiration (sent at 9 AM daily when check runs)
Subscription status notifications
Service updates and important announcements
Your Responsibilities:
Provide valid, active email address
Maintain access to email account
Check email regularly for renewal reminders
Configure spam filters to allow messages from pay@scream4u.icu
Update email address if it changes (Settings → Update Email Address)
Consequences of Invalid Email: You will NOT receive renewal reminders and may miss expiration. We are NOT responsible for missed communications due to invalid email or spam filters.
3.7 Promotional Free Subscription Codes
We may grant select users complimentary activation codes for promotional, charitable, or testing purposes.
Promotional Code Terms:
Standard Duration: Promotional codes provide standard 365-day subscription access
Non-Transferable: Codes cannot be shared, sold, or transferred
Device-Locked: Once activated, codes are permanently locked to that device
No Restoration: Codes cannot be restored or transferred to different device (Note: Device verification exception applies)
No Monetary Value: Codes have no cash value and cannot be redeemed for refunds
Revocable: We reserve the right to revoke codes for fraud, abuse, or Terms violations
No Renewal Guarantee: No obligation to provide renewal codes after expiration
Lost Device: If you lose device with promotional code, the code cannot be recovered or reissued. Standard paid subscription required for new device.
3.8 Refunds and Cancellation

Failed Payment Refunds:

Founders Tier Full: If you pay $9.99 but Founders tier is full (1,000/1,000), you receive automatic rejection email offering Regular tier at $19.99. Refund processed manually through PayPal within 3-5 business days.
Cancellation:

Takes effect at end of billing period
Continue using paid features until expiration
No refund for remaining time after 30-day window
Local data remains on device after cancellation
4. Your Responsibilities
4.1 Accurate Information
You agree to provide and maintain:
Current Address: Update when traveling, moving, or changing location
Valid Contacts: Correct phone numbers with country codes
Accurate Name: So contacts can identify you
Examples of when to update address: Traveling (hotel), visiting family, moving, extended stays away from home
4.2 Appropriate Use
You must NOT:
Send false or fraudulent emergency alerts
Use the app to harass or spam contacts
Intentionally provide incorrect address information
Share subscription across multiple devices
Circumvent device verification or subscription limits
Use for illegal activities
Reverse engineer or extract source code
Abuse test feature
4.3 Contact Management
Only add contacts who consent to receive emergency alerts
Verify phone numbers are correct and active
Inform contacts about potential messages
Add contacts able and willing to help
Update if contact information changes
4.4 Testing and Maintenance
Test the app after setup and periodically thereafter
Warn contacts before sending test alerts
Keep device software updated
Maintain device security (passcode/biometrics)
Ensure cellular service is available
4.5 SMS Costs
You are responsible for SMS charges from your cellular carrier
Standard messaging rates apply
International SMS may incur additional charges
Must manually tap "Send" in SMS app
Verify messages before sending
5. Service Limitations
5.1 What the App Does NOT Do
The app does NOT:
Connect to professional emergency services
Provide 24/7 monitoring or response
Guarantee SMS delivery or contact response
Send SMS automatically (you must tap "Send")
Track your location via GPS
Automatically update your address
Verify address accuracy
Provide medical advice or emergency medical services
Confirm contacts received or read messages
5.2 Technical Dependencies
The app's functionality depends on:

6. Disclaimers and Liability
6.1 Warranty Disclaimer
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We disclaim all warranties, including:
Merchantability and fitness for a particular purpose
Non-infringement
Error-free or uninterrupted operation
SMS delivery or emergency response
Address accuracy or verification
Availability or reliability
6.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages
Our total liability shall not exceed the subscription amount ($9.99 or $19.99 USD)
We are not liable for:
SMS delivery failures, delays, or network outages
Incorrect or outdated address information you provide
Your failure to update address when location changes
Emergency response delays or lack of response
Device malfunctions or battery failures
Actions or inactions of emergency contacts
Harm resulting from false, delayed, or failed alerts
Payment processing issues handled by PayPal
6.3 Indemnification
You agree to indemnify us from claims arising from:
Your use or misuse of the app
False or fraudulent alerts
Failure to provide or update accurate address

Unauthorized subscription sharing

7. Privacy and Data

7.1 Data Storage Summary
Local Only: Name, address, contacts stored on your device (we cannot access)
Delete data: Uninstall app or Settings → Home button
8. Intellectual Property
The app and all content is owned by Scream4U.icu and protected by copyright, trademark, and intellectual property laws.
You receive: Limited, non-exclusive, non-transferable license to use the app
You may NOT:
Copy, modify, distribute, sell, or lease the app
Reverse engineer or extract source code
Remove proprietary notices
Use our trademarks without permission
Create derivative works
9. Termination
9.1 By You
Cancel subscription anytime via support@scream4u.icu
Uninstall app to stop using service
No refund beyond 30-day policy
Local data remains on device until deleted
9.2 By Us
We may terminate immediately for:
Terms violations
Fraudulent or abusive behavior
Simultaneous multi-device use
Illegal activities
Malicious false alerts
Circumventing subscription verification
9.3 Effect
Access immediately ceases
Subscription cancelled (no refund except 30-day window)
Local data remains on device
Liability, Privacy, IP, and Governing Law sections survive
10. Updates and Changes
10.1 App Updates
We may update for improvements, security, or bug fixes
Updates may be required for continued use
Not obligated to provide updates indefinitely

11.2 Dispute Resolution

Arbitration: Unresolved disputes go to binding arbitration in South Africa
Class Action Waiver: You waive class action participation (where permitted)
Small Claims: May pursue in small claims court if eligible
Exceptions: IP disputes, small claims matters, and injunctive relief requests not subject to arbitration
12. Miscellaneous
12.1 Entire Agreement
These Terms plus our Privacy Policy constitute the entire agreement, superseding prior agreements.
12.2 Severability
If any provision is unenforceable, it will be limited minimally while remaining provisions stay in effect.
12.3 No Waiver
Our failure to enforce doesn't constitute waiver. Waivers must be in writing.
12.4 Assignment
You may not assign these Terms without our written consent. We may assign (e.g., merger/acquisition).
12.5 Force Majeure
Not liable for delays due to circumstances beyond reasonable control (natural disasters, war, pandemics, network failures, PayPal service interruptions, etc.).
