1. Agreement to Terms

By downloading, installing, or using Scream4U.icu ("App"), you agree to these Terms & Conditions ("Terms"). If you disagree with any part of these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you") and Scream4U.icu ("we," "us," "our").

2. How the App Works

2.1 Service Description

Scream4U.icu is an offline-first emergency alert application that:

• Stores your personal information locally on your device
• Generates pre-filled emergency SMS messages
• Opens your device's native SMS app for sending alerts
• Allows you to manage emergency contacts and address information
• Provides test functionality to verify the system works

2.2 Emergency Alert Process

When you press an emergency button:

1. The app generates an SMS containing: emergency type, your name, your address, and timestamp
2. Your device's SMS app opens with pre-filled messages for your contacts
3. You manually tap "Send" - the app cannot send automatically
4. SMS is sent via your cellular carrier (not through our servers)

2.3 Alert Types

Paid Subscription Required:

• Medical Emergency
• Fire Emergency
• Intruder Alert
• Personal Safety/GBV

Free (3 uses, then unlimited with subscription):

• Test Alert - clearly marked as "NOT A REAL EMERGENCY"

2.4 Technical Requirements

• iOS 13+ or Android 6+ device
• Cellular signal for SMS (internet not required for alerts)
• SMS permissions granted (Android)
• Functional native SMS app
• Valid contact phone numbers

3. Subscription and Payment

3.1 Pricing and Plans

Payment Processing: All payments processed securely by Stripe, Inc. (PCI-DSS compliant). Prices shown in USD; Stripe may convert to your local currency.

3.2 Billing and Renewal

• Billed annually in advance ($19.99/year)
• Automatic renewal unless cancelled before renewal date
• Stripe sends renewal notifications before billing
• Manage subscription: Settings → Subscription Status → Manage Subscription (opens Stripe portal)
• Charges appear as "Scream4U.icu" on statements

3.3 Device Limitations

• One Device Per Subscription: Each subscription is linked to one active device via device identifier
• Transfer Anytime: Use Settings → Transfer Device to move subscription to new device
• Transfer Process: On new device, tap "Restore Purchase" → "Transfer to This Device" (previous device auto-deactivated)
• Note: Address information does NOT transfer - you must re-enter it on the new device
• Sharing Prohibited: Using one subscription on multiple devices simultaneously is prohibited and may result in termination

3.4 Refunds and Cancellation

30-Day Money-Back Guarantee:

• Full refund available within 30 days of purchase
• Email support@scream4u.icu with "Refund Request"
• Include: subscription email and reason
• Processed via Stripe to original payment method
• Allow 5-10 business days

Cancellation:

• Cancel anytime through Stripe portal (Settings → Subscription Status → Manage Subscription)
• Takes effect at end of billing period
• Continue using paid features until expiration
• No refund for remaining time after 30-day window
• Local data remains on device after cancellation

4. Your Responsibilities

4.1 Accurate Information

You agree to provide and maintain:

• Current Address: Update when traveling, moving, or changing location
• Valid Contacts: Correct phone numbers with country codes
• Accurate Name: So contacts can identify you

Examples of when to update address: Traveling (hotel), visiting family, moving, extended stays away from home

4.2 Appropriate Use

You must NOT:

• Send false or fraudulent emergency alerts
• Use the app to harass or spam contacts
• Intentionally provide incorrect address information
• Share subscription across multiple devices
• Circumvent device verification or subscription limits
• Use for illegal activities
• Reverse engineer or extract source code
• Abuse test feature

4.3 Contact Management

• Only add contacts who consent to receive emergency alerts
• Verify phone numbers are correct and active
• Inform contacts about potential messages
• Add contacts able and willing to help
• Update if contact information changes

4.4 Testing and Maintenance

• Test the app after setup and periodically thereafter
• Warn contacts before sending test alerts
• Keep device software updated
• Maintain device security (passcode/biometrics)
• Ensure cellular service is available

4.5 SMS Costs

• You are responsible for SMS charges from your cellular carrier
• Standard messaging rates apply
• Must manually tap "Send" in SMS app
• Verify messages before sending

5. Service Limitations

5.1 What the App Does NOT Do

The app does NOT:

• Connect to professional emergency services
• Provide 24/7 monitoring or response
• Guarantee SMS delivery or contact response
• Send SMS automatically (you must tap "Send")
• Track your location via GPS
• Automatically update your address
• Verify address accuracy
• Provide medical advice or emergency medical services
• Confirm contacts received or read messages

5.2 Technical Dependencies

The app's functionality depends on:

SMS messages may fail or be delayed due to:

• No cellular signal or weak signal
• Invalid or incorrect phone numbers
• Carrier network issues or restrictions
• Recipient phone off or out of service
• Network congestion
• Device or SMS app malfunctions

6. Disclaimers and Liability

6.1 Warranty Disclaimer

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We disclaim all warranties, including:

• Merchantability and fitness for a particular purpose
• Non-infringement
• Error-free or uninterrupted operation
• SMS delivery or emergency response
• Address accuracy or verification
• Availability or reliability

6.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed $19.99 USD (the subscription amount)
• We are not liable for:
  • SMS delivery failures, delays, or network outages
  • Incorrect or outdated address information you provide
  • Your failure to update address when location changes
  • Emergency response delays or lack of response
  • Device malfunctions or battery failures
  • Actions or inactions of emergency contacts
  • Harm resulting from false, delayed, or failed alerts

6.3 Indemnification

You agree to indemnify us from claims arising from:

• Your use or misuse of the app
• False or fraudulent alerts
• Failure to provide or update accurate address
• Violation of these Terms
• Unauthorized subscription sharing
• SMS messages sent to contacts

7. Privacy and Data

Please review our Privacy Policy for details on data collection and use.

7.1 Data Storage Summary

• Local Only: Name, address, contacts stored on your device (we cannot access)
• Stripe: Email, device ID, subscription status, payment info (handled by Stripe)
• No Cloud: We don't operate servers for your personal data
• No Tracking: No analytics, GPS tracking, or location services

7.2 Your Control

• Update address anytime: Settings → Edit Home Address
• Manage contacts: Settings → Edit Emergency Contacts
• Delete data: Uninstall app or Settings → Home button

8. Intellectual Property

The app and all content is owned by Scream4U.icu and protected by copyright, trademark, and intellectual property laws.

You receive: Limited, non-exclusive, non-transferable license to use the app

You may NOT:

• Copy, modify, distribute, sell, or lease the app
• Reverse engineer or extract source code
• Remove proprietary notices
• Use our trademarks without permission
• Create derivative works

9. Termination

9.1 By You

• Cancel subscription anytime via Stripe portal
• Uninstall app to stop using service
• No refund beyond 30-day policy
• Local data remains on device until deleted

9.2 By Us

We may terminate immediately for:

• Terms violations
• Fraudulent or abusive behavior
• Simultaneous multi-device use
• Illegal activities
• Malicious false alerts
• Circumventing subscription verification

9.3 Effect

• Access immediately ceases
• Subscription cancelled (no refund except 30-day window)
• Local data remains on device
• Liability, Privacy, IP, and Governing Law sections survive

10. Updates and Changes

10.1 App Updates

• We may update for improvements, security, or bug fixes
• Updates may be required for continued use
• Not obligated to provide updates indefinitely
• You're responsible for downloading updates

10.2 Terms Changes

• We may modify these Terms anytime
• Material changes communicated via in-app notification, email, or updated date
• Continued use = acceptance
• If you disagree, stop using and cancel subscription

10.3 Service Discontinuation

• We may discontinue service with 30 days notice
• Active subscriptions refunded pro-rata
• Local data remains on your device

11. Governing Law

11.1 Jurisdiction

These Terms are governed by South African law. International users agree to South African jurisdiction.

11.2 Dispute Resolution

1. Informal Resolution: Contact support@scream4u.icu for 30-day good faith negotiation
2. Arbitration: Unresolved disputes go to binding arbitration in South Africa
3. Class Action Waiver: You waive class action participation (where permitted)
4. Small Claims: May pursue in small claims court if eligible

Exceptions: IP disputes, small claims matters, and injunctive relief requests not subject to arbitration

12. Miscellaneous

12.1 Entire Agreement

These Terms plus our Privacy Policy constitute the entire agreement, superseding prior agreements.

12.2 Severability

If any provision is unenforceable, it will be limited minimally while remaining provisions stay in effect.

12.3 No Waiver

Our failure to enforce doesn't constitute waiver. Waivers must be in writing.

12.4 Assignment

You may not assign these Terms without our written consent. We may assign (e.g., merger/acquisition).

12.5 Force Majeure

Not liable for delays due to circumstances beyond reasonable control (natural disasters, war, pandemics, network failures, etc.).

12.6 Age Requirements

• Minimum age: 13 years
• Under 18: Parent/guardian permission required
• Parents/guardians responsible for minors' use

12.7 Third-Party Beneficiaries

Stripe, Inc. is a third-party beneficiary regarding payment processing provisions.
